Terms of Agreement

By participating in a course or class provided by Return to Magic, or agreeing to these terms, you agree to the following provisions:

1. Outline of Agreement

1.1 Definitions: Return to Magic LLC t/a Return to Magic (referred to in this agreement as Return to Magic) agrees to provide training for the course that you have chosen. In this agreement, reference to ‘Return to Magic’ includes all tutors who are employed, or act on behalf of Return to Magic.

2. Payment

2.1 Pricing and Payment: The training is for the course(s) you have selected. In exchange for this service, you agree to pay the price stated at the time of booking. Upon signing this agreement, you agree to pay a non-refundable and non-transferable deposit.

2.2 Payment Deadline: The total amount is due no later than 14 days before the start of the course. Failure to make payment will result in the cancellation of your place on the course and the deposit will not be refunded.

3. Cancellation

3.1 Cancellation Policy: You are permitted to cancel your place on the course/event by way of written notice to ryan@returntomagic.com. If the cancellation is made within 14 days of the date of this contract, you will be given the option to reschedule or to receive a refund. Please note that any reasonable costs that have already been incurred by Return to Magic will not be refundable. If you cancel your place after 14 days of the date of this contract any monies paid will not be refundable.

4. Results and Guarantees

4.1 No Guarantees: Return to Magic does not guarantee any results or make any health claims. Although ThetaHealing® has great benefits, results are dependent on a number of factors including, but not limited to your commitment to the course, participation, existing health conditions. Any testimonials and examples are not intended to represent or guarantee that you will achieve the same or similar results.

4.2 Disclaimer: Return to Magic does not provide medical, legal, investment or business advice. All opinions are provided for your consideration and should not be solely relied upon. It is your responsibility to obtain professional advice.

5. Health

5.1 Health Precautions: In order to experience the full benefits of ThetaHealing®, please refrain from drinking alcohol or consuming any illegal drugs for at least 48 hours prior to the start of the course/event as this may affect your ability to participate.

5.2 Medical Disclaimer: Return to Magic does not claim to heal, treat or cure any health conditions. You must continue to take any prescribed medication throughout the entire duration of the course.

5.3 Health Conditions: It is your responsibility to inform Return to Magic of any health conditions you have which may impact on your ability to participate on the course.

5.4 Fitness Requirement: In order to gain full value from the course, you must be fit and healthy. If you have a health condition which will impact on your ability to participate on the course, Return to Magic may suggest an alternative method of contact or decline participation for your and other course participant’s safety.

5.5 Substance Policy: Your mental state may be affected by the consumption of alcohol or illegal drugs and it is not permitted at any time whilst you are on the course. Return to Magic reserves the right to cancel your place on the course in accordance with clause 11 of this agreement if you breach this requirement.

5.6 Indemnification:  You agree to indemnify Return to Magic against any claims arising from your participation in all courses, private session, and events, including health-related matters and sharing testimonials.

6. Certification

6.1 Certificate of Completion: Upon successful completion of the course you will receive a certificate of completion.

6.2 Certification Criteria: The tutor reserves the right to refuse certification if they feel that you have not fully participated in the course.

6.3 Attendance Requirement: If you fail to attend part of the course the tutor reserves the right to withhold certification until you have completed the required syllabus.

6.4 Additional Fees: If you fail to attend any part of the course you will be required to pay an additional fee to attend those days on a future course.

7. Business and Self-Promotion

7.1 Promotion Policy: Self-promotion is not permitted on any platform hosted by Return to Magic unless permission is obtained directly from us.

7.2 Platform Definition: A platform hosted by Return to Magic includes, but is not limited to, courses, events, practice groups, WhatsApp groups and other social media groups.

7.3 Solicitation Prohibition: Self-promotional material is not permitted on any platform hosted by Return to Magic and you must not solicit clients on any platform hosted by Return to Magic.

7.4 Private Offerings: Should you wish to privately offer sessions to clients, this will be your sole responsibility and your business will be separate from Return to Magic.

7.5 Partnership Disclaimer: Participation in a course/event is not intended to, or shall not be deemed to establish any partnership or joint venture between you and Return to Magic.

7.6 Client Acquisition: Return to Magic is not responsible for providing you with clients.

7.7 Termination Clause: Any self-promotion will result in the termination of this agreement in accordance with clause 11 of this agreement.

8. Reasonable Use of Equipment

8.1 Equipment Handling: Return to Magic uses various types of equipment during courses which include, but is not limited to electrical equipment, speakers, projectors, diffusers.

8.2 Safety Precautions: Use of this equipment requires specific handling and you must take reasonable care at all times during the course to ensure your safety.

8.3 Liability Disclaimer: Return to Magic will not be liable for any injury or loss which is caused by your negligence.

9. Off-Site Activities

9.1 Off-Site Arrangements: There may be occasions where part of a course will take place off-site. In those circumstances, it is your responsibility to ensure you meet the group on time at the specified location.

9.2 Travel Responsibility: You will be responsible for all travel and subsistence costs as these are not included in the course fee.

9.3 Safety Measures: You must take reasonable care to ensure your safety and security for the entire duration of the offsite activity.

10. Force Majeure

10.1 Unforeseen Circumstances: If, as a result of an act of God, force majeure, public emergency, restriction imposed by law or for any other cause beyond Return to Magic’s reasonable control, we are unable to provide services to you, Return to Magic shall not be in breach of this agreement but shall be authorized to substitute a reasonably satisfactory date and time to provide services.

10.2 Fee Waiver: If no such time is available, the remainder of the fees due for any service(s) that have not yet been provided will be waived.

10.3 Non-Liability: Return to Magic shall not be liable for inability to provide services or fulfil the agreement in those circumstances.

11. Termination

11.1 Disruptive Behavior: Return to Magic reserves the right to terminate this agreement at any point if we feel that you are being disruptive, are acting in breach of the law, or are in violation of this agreement. All fees will become payable by you upon termination of this agreement.

12. Confidentiality

12.1 Definition of Confidential Information: Confidential information refers to any data or information relating to you, whether business or personal, which would reasonably be considered to be private or proprietary to you or us; that is not generally known, and; where the release of that confidential information could reasonably be expected to cause harm to you or us.

12.2 Confidentiality Obligations: Return to Magic agrees that we will not disclose, divulge, reveal, report or use, for any purpose, any confidential information which we have obtained, except as authorized by you or as required by law. The obligations of confidentiality will apply for the duration of the course/event and will survive indefinitely upon termination of this agreement.

12.3 Client Confidentiality: All written and oral information and material disclosed or provided by you to Return to Magic under this agreement is confidential information regardless of whether it was provided before or after the date of this agreement or how it was provided to Return to Magic.

12.4 Third-Party Confidentiality: Any confidential information disclosed to you by the tutor or other participants as part of the course must also remain confidential.

13. Photography and Filming

13.1 Media Consent: You consent to Return to Magic using photographs and/or video recordings including images of you, both internally and externally to promote our services.

13.2 Usage Authorization: You understand that these images may be used in print and digital media formats, including but not limited to print publications, website, e-marketing, posters, banners, advertising, film, social media, and teaching purposes.

13.3 Data Access: Under certain jurisdictions governing data protection law, you may have the right to request to see a copy of the information we hold about you and to request corrections or deletions of the information that is no longer required. Please email ryan@returntomagicnow.com if you would like to exercise your rights to data privacy. Please provide your jurisdiction, proof of citizenship under stated jurisdiction, and your privacy rights request.

13.4 Opt-Out Option: If you do not wish to be included in any photographs or video recordings you must inform us prior to the start of the course.

13.5 Withdrawal Right: You can ask Return to Magic to stop using your images at any time, in which case it will not be used in future publications, but may continue to appear in publications already in circulation.

14. Testimonials

14.1 Feedback Authorization: We may ask you to provide a testimonial of your experience with us.

14.2 Testimonial Usage: Should you wish to provide a testimonial, you confirm that you give your consent for Return to Magic to use the text in its entirety, or in part in order to promote our business.

14.3 Media Authorization: You confirm that the testimonial can be used in all media, including, but not limited to: printed materials, business communications, presentations, social media and in the advertising of services generally.

14.4 Editing Authorization: You give consent to Return to Magic to edit the testimonial as necessary, without consulting you, provided the message remains the same.

14.5 Voluntary Consent: You give Return to Magic consent to refer to your business name and first name on the testimonial and agree that the testimonial is given voluntarily and you will not receive financial compensation for it.

15. Governing Law

15.1 Jurisdiction Clause: This Agreement shall be interpreted, construed and enforced in accordance with US law and shall be subject to the exclusive jurisdiction of the United States Courts.

16. Severability:  If any provision of this agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

17. Entire Agreement

17.1 Agreement Scope: This Agreement is the entire agreement and understanding between Return to Magic and you and supersedes any prior agreement or understanding whether oral or written relating to this Agreement.
